2. Scope of Services

Atama provides professional web design and development services, including but not limited to:

• Custom website design and development
• Landing page design
• Website redesigns and refreshes
• Responsive and mobile-optimised development
• Basic SEO setup and optimisation
• Website maintenance and support
• Performance optimisation

The specific scope, deliverables, and timeline for each project will be outlined in a written project proposal or agreement provided before work begins.

3. Service Packages and Pricing

We offer three standard service packages:

3.1 Starter Package — €499

A clean, professional single-page website ideal for new businesses, freelancers, and personal brands. Includes responsive design, basic SEO setup, contact form integration, and 30 days of post-launch support.

3.2 Business Package — €999

A multi-page website with expanded functionality for growing businesses. Includes up to 5 pages, custom design, content management guidance, analytics integration, and 60 days of post-launch support.

3.3 Premium Package — €1,999

A comprehensive, fully custom website with advanced features. Includes unlimited pages, bespoke design, advanced animations and interactions, SEO optimisation, performance tuning, and 90 days of post-launch support.

Custom projects outside these packages will be quoted individually based on scope and complexity. All prices are exclusive of VAT where applicable.

4. Project Process

Our standard project process consists of the following phases:

1. Discovery: We learn about your business, goals, target audience, and design preferences through a discovery questionnaire or call.
2. Proposal: We provide a detailed project proposal outlining scope, timeline, deliverables, and pricing.
3. Design: We create the visual design for your website, presented as mockups or a working prototype for your review and feedback.
4. Development: Once the design is approved, we build the fully functional website.
5. Review and revisions: You review the completed website and request revisions within the included revision rounds.
6. Launch: After final approval, we deploy your website to your hosting environment.
7. Post-launch support: We provide support for the period specified in your package to address any issues or minor adjustments.

5. Payment Terms

5.1 Payment Schedule

Unless otherwise agreed in writing, payments are structured as follows:

• 50% upfront deposit: Due before work begins. No work will commence until the deposit is received.
• 50% final payment: Due upon project completion, before the website is deployed to your live environment.

5.2 Payment Methods

We accept bank transfer and other payment methods as agreed. Payment details will be provided on your invoice.

5.3 Late Payment

Invoices are due within 14 days of issue unless otherwise specified. We reserve the right to pause or suspend work on overdue accounts. Late payments may incur interest at a rate of 1.5% per month on the outstanding balance.

5.4 Additional Costs

Third-party costs such as domain registration, hosting fees, premium plugins, stock photography, or other external services are not included in our pricing unless explicitly stated. These costs are the Client's responsibility.

6. Revisions

6.1 Included Revisions

Each project includes 2 rounds of revisions at no additional cost. A "round of revisions" is defined as a single consolidated set of feedback and change requests submitted in writing (e.g., via email).

6.2 Additional Revisions

Revisions beyond the included 2 rounds are billed at €75 per additional round. We will notify you before proceeding with any billable revision work and obtain your written approval.

6.3 Scope of Revisions

Revisions cover reasonable adjustments to the approved design, such as colour changes, layout tweaks, copy updates, and image swaps. Requests that significantly alter the project scope, require new functionality, or amount to a redesign will be treated as additional work and quoted separately.

7. Client Responsibilities

To ensure timely and successful project delivery, you agree to:

• Provide content promptly: Supply all text, images, logos, brand guidelines, and other materials needed for the project within agreed timeframes.
• Provide timely feedback: Review deliverables and provide consolidated feedback within 5 business days of each review stage, unless otherwise agreed.
• Designate a point of contact: Appoint a single decision-maker who can provide approvals and feedback on behalf of your organisation.
• Ensure content legality: Confirm that all content you provide is accurate, does not infringe on third-party rights, and complies with applicable laws.
• Provide access: Grant necessary access to hosting accounts, domain registrars, and any other platforms required for project delivery.

Delays caused by late content delivery or feedback may result in adjusted timelines and, in some cases, additional charges.

8. Delivery Timeline

Estimated timelines are provided in the project proposal and depend on the complexity of the project and the timely provision of content and feedback by the Client. Typical timelines are:

• Starter Package: 1–2 weeks
• Business Package: 2–4 weeks
• Premium Package: 4–8 weeks

Timelines are estimates, not guarantees. We will communicate proactively if any delays arise. Atama is not liable for delays caused by the Client's failure to provide content, feedback, or approvals in a timely manner.

9. Intellectual Property

9.1 Ownership Transfer

Upon receipt of full payment, all rights to the final deliverables — including custom designs, code, and assets created specifically for your project — are transferred to you. You will own the completed website and its custom elements.

9.2 Pre-existing Materials

Any pre-existing tools, code libraries, frameworks, or assets used in the project that were not created specifically for you remain the property of their respective owners. You are granted a non-exclusive, perpetual licence to use these elements as part of your website.

9.3 Portfolio Rights

We reserve the right to display the completed project in our portfolio, case studies, and marketing materials unless you request otherwise in writing.

9.4 Third-Party Assets

Any third-party assets (stock photos, fonts, icons, plugins) used in the project are subject to their respective licences. We will inform you of any licensing requirements for third-party assets included in your project.

10. Cancellation and Refunds

10.1 Cancellation by Client

You may cancel the project at any time by providing written notice. In the event of cancellation:

• Before work begins: The upfront deposit will be refunded in full, minus a €50 administrative fee.
• After work has begun: The deposit is non-refundable. You will be invoiced for any work completed beyond the deposit amount at our standard hourly rate (€75/hour).
• After design approval: Both the deposit and the final payment become due, as the substantive creative work has been completed.

10.2 Cancellation by Atama

We reserve the right to terminate a project if the Client is unresponsive for more than 30 consecutive days, fails to make required payments, or engages in conduct that makes continued collaboration unreasonable. In such cases, we will provide written notice and invoice for work completed to date.

10.3 Project Pause

If a project is paused at the Client's request for more than 30 days, we reserve the right to reassess the timeline and, if necessary, adjust the project quote to reflect any additional effort required to resume work.

11. Limitation of Liability

To the maximum extent permitted by law:

• Atama's total liability arising from or related to the project shall not exceed the total amount paid by the Client for the specific project in question.
• Atama shall not be liable for any indirect, incidental, consequential, or special damages, including loss of revenue, profit, data, or business opportunity, even if advised of the possibility of such damages.
• Atama is not responsible for any loss or damage resulting from the Client's use, modification, or mismanagement of the delivered website after handover.
• Atama does not guarantee specific business results, search engine rankings, or conversion rates from the delivered website.

12. Warranties and Disclaimers

We warrant that our services will be performed with reasonable skill and care. However:

• We do not warrant that the website will be error-free, uninterrupted, or compatible with all software, hardware, or future browser updates.
• We do not warrant the accuracy, completeness, or reliability of any content provided by the Client.
• Except as expressly stated in these Terms, all warranties, whether express or implied, are excluded to the fullest extent permitted by law.

13. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the project. This includes business strategies, unreleased content, login credentials, and financial information. This obligation survives the termination of the agreement.

14. Force Majeure

Neither party shall be liable for delays or failure to perform obligations due to circumstances beyond their reasonable control, including but not limited to natural disasters, pandemics, internet outages, government actions, or other force majeure events.

15. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which [COMPANY_NAME] is registered. Any disputes arising from or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of the jurisdiction in which [COMPANY_NAME] is registered.

16. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated "Last updated" date. Changes do not apply retroactively to projects already in progress under a signed agreement.
